News | HOTMA for HUD extended to 2027

Section 6.2 of Notice H 2023–10 requires Multifamily Housing Owners to be in full compliance with the HOTMA final rule and HUD’s updated income and asset documentation requirements for income certifications having an effective date on or after January 1, 2025. HUD later published Notice H 2025–03 that extended the compliance date to January 1, 2026. This newest Notice extends the compliance date to January 1, 2027. The requirement applies to Owners participating in the HUD programs listed in section 4 (Applicability) of Notice H 2023–10.

Almost all LIHTC and HOME/NHTF agencies, and Rural Development have converted to HOTMA at this point, so this will primarily be of interest to our friends with HUD properties.

Details:

  • Legally, the HOTMA change to regulation was effective 1/01/2024.
  •  The HOME/NHTF and other HUD block grant programs deadline remains 1/01/2026, with many PJs and grantees exercising their option to implement already. See HUD CPD Notice at FR-6057-N-06.
  • Rural Development converted in July of 2025.
  • LIHTC implementation is entirely up to each state LIHTC agency.
